These Terms govern your use of the Postr application, website, APIs, and related services (the “Service”) operated by Gyankaar Technologies Private Limited (“we”, “us”, or “our”).

By creating an account, purchasing credits, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Postr.

1. Eligibility and accounts

You must be at least 18 years old and capable of entering a binding agreement. You must provide accurate information and keep your business profile current.

Postr uses mobile OTP authentication. You are responsible for controlling access to your phone and account and for promptly reporting unauthorized activity. Never share an OTP with anyone, including someone claiming to represent Postr.

2. The Service

Postr provides a curated poster feed and AI-assisted tools that can combine templates, user instructions, images, custom fields, languages, and business branding to produce marketing images. Features, feed content, models, and availability may change over time.

3. Your content and permissions

You retain your rights in the images, logos, text, and other material you submit (“User Content”). You grant us a limited, worldwide, non-exclusive license to host, copy, transmit, transform, and display User Content only as reasonably necessary to operate, secure, and support the Service.

You confirm that you have all rights and permissions needed for User Content, including permission to use a person’s likeness, trademarks, copyrighted works, and images of children. You are responsible for the accuracy and legality of claims, prices, dates, reviews, and contact details used in a poster.

4. AI-generated output

AI output can be inaccurate, incomplete, unexpected, or similar to material generated for others. We do not guarantee uniqueness, factual accuracy, spelling, quality, fitness for a particular campaign, or eligibility for intellectual-property protection.

You must review each output before publishing or relying on it. Subject to applicable law and third-party rights, you may use output created for your account for personal or business purposes.

5. Acceptable use

You must not use Postr to:

• create or distribute illegal, fraudulent, deceptive, hateful, exploitative, sexually explicit, or dangerous content;
• infringe privacy, publicity, copyright, trademark, or other rights;
• impersonate a person or business, fabricate endorsements, or publish a misleading customer review;
• upload malicious code or attempt to bypass credits, authentication, rate limits, or security controls;
• scrape, resell, reverse engineer, disrupt, or overload the Service; or
• use generated output without conducting the review reasonably expected for your intended use.

We may block content or suspend access where reasonably necessary to protect users, providers, or the Service.

6. Credits

Creating an image consumes the credits shown in Postr. Signup or promotional credits have no cash value and may be subject to additional conditions. A credit reserved for a creation recorded as failed is automatically restored. Successfully completed creations ordinarily consume the credit even if you decide not to use the output.

Credits are linked to the account that received or purchased them and may not be sold, transferred, or redeemed for cash except where law requires otherwise.

7. Payments and subscriptions

Postr uses PhonePe for recurring subscriptions and Razorpay for one-time credit purchases. Prices, billing periods, trial terms, included credits, and taxes are shown before you confirm a purchase.

By starting a subscription, you authorize recurring charges according to the selected plan until cancellation is processed. You are responsible for cancelling before the next billing date if you do not want renewal. Payment confirmation may be subject to provider processing and reconciliation.

8. Storage and sharing

Postr may store uploads and output in cloud infrastructure and provide link-accessible media URLs for downloading or sharing. Treat these links as shareable: anyone with a link may be able to view the image. You should not upload confidential or highly sensitive material.

9. Intellectual property

Postr, its software, interfaces, brand, curated feed, and original materials are owned by us or our licensors. Except for rights expressly granted here, no rights are transferred to you. You may not copy or use our branding or product materials in a way that suggests sponsorship or affiliation.

10. Third-party services

The Service depends on cloud, AI, messaging, payment, and network providers. Their terms may apply to features you use. We are not responsible for a third-party service outside our reasonable control, but we will use reasonable efforts to operate and support Postr.

11. Availability and changes

We may maintain, update, restrict, or discontinue features. We do not guarantee uninterrupted availability or that every generation will complete. We may introduce reasonable limits to protect stability, security, or provider capacity.

12. Suspension and termination

You may stop using Postr at any time. We may suspend or terminate access for a material breach, unlawful use, fraud, security risk, non-payment, provider requirement, or risk of harm. Where appropriate, we will provide notice or an opportunity to correct the issue.

Provisions concerning payments, ownership, liability, disputes, and any rights or obligations that should reasonably survive will continue after termination.

13. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation. Mandatory warranties and consumer rights remain unaffected.

14. Limitation of liability

To the extent permitted by law, we will not be liable for indirect, incidental, special, exemplary, or consequential loss, loss of profit, goodwill, opportunity, or data arising from use of Postr. Our aggregate liability relating to the Service will not exceed the amount you paid to Postr in the six months before the event giving rise to the claim.

This limitation does not apply where liability cannot lawfully be limited or excluded.

15. Indemnity

To the extent permitted by law, you will indemnify us against third-party claims and reasonable costs arising from your User Content, your published posters, your infringement of another person’s rights, or your material breach of these Terms.

16. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer forum or jurisdiction available under applicable law, courts in Bengaluru, Karnataka will have exclusive jurisdiction.

17. Changes and general terms

We may update these Terms and will publish the revised date above. If a change materially affects existing rights, we will provide notice where required. If one provision is unenforceable, the remaining provisions continue. Failure to enforce a provision is not a waiver.
